Terms of Use
Effective 23 September 2026
§ 1. General Provisions
These Terms of Use set out the rules governing the use of the “TikChat” web application, available at tikchat.eu, including the rules concerning:
creating and maintaining an Account;
using features related to displaying data from TikTok LIVE streams;
using the Free Version;
purchasing the Paid Plan;
submitting complaints and reporting irregularities.
The Service Provider, owner of the Application and administrator of User Accounts is:

These Terms of Use are made available free of charge within the Application in a form that enables them to be saved, reproduced and printed.
These Terms of Use are available for review before using TikChat. The public registration and paid-plan flows will require explicit acceptance when introduced.
Information concerning the processing of personal data and the use of cookies and similar technologies is provided in the Privacy Policy.
Acceptance of these Terms of Use is separate from any consent relating to marketing, analytics or cookies that are not necessary for the operation of the Application.
§ 2. Definitions
For the purposes of these Terms of Use, the following terms shall have the meanings set out below:
Application or TikChat – the “TikChat” web application available via a web browser at tikchat.eu.
Service Provider – MattMedia Mateusz Olech.
User – a natural person holding an Account in the Application.
Consumer – a User who is a consumer within the meaning of the Polish Civil Code.
Account – an individual User profile created upon completion of the registration process.
TikTok LIVE or LIVE – a publicly available livestream conducted via the TikTok platform.
LIVE Session – the use of TikChat by the User in connection with a specific TikTok LIVE stream, during which the Application retrieves and displays available data relating to the stream.
LIVE Data – publicly available information related to a TikTok LIVE stream, which may include in particular:
the viewer’s username or nickname;
the content of comments;
avatar;
TikTok user identifier;
gifter level;
fan club status;
information about gifts sent;
information about following the profile;
information about likes on the livestream;
information about a user joining the livestream.
Viewer Name – information assigned by the User to a particular viewer within TikChat in order to facilitate identification of that person while using the Application.
Free Version – a version of the Application allowing the User to use TikChat during two qualifying LIVE Sessions without charge. A session qualifies when TikChat confirms a connection to the LIVE and that session lasts at least ten minutes. This allowance applies to the Account in total and does not renew monthly.
Paid Plan or Plan – paid access to the Application allowing the User to use TikChat beyond the limit applicable to the Free Version, under the terms presented to the User before purchase.
Subscription – an agreement concerning the Paid Plan entered into for monthly billing periods that renew automatically.
Stripe – an external provider handling payments, settlements and Subscription management.
Account Panel – the part of the Application available after logging in, allowing the User, in particular, to manage their Account and Subscription.
Digital Service – a service provided through the Application enabling access to TikChat functionalities.
§ 3. Nature of the Application and Relationship with TikTok
TikChat is an independent online application designed to help creators and other Users monitor and manage publicly available chat and events associated with TikTok LIVE streams.
The Application does not conduct LIVE streams and does not replace the TikTok platform.
Using TikChat does not require logging into TikTok or providing TikTok login credentials. The User assigns one TikTok username to their TikChat Account during setup. Changing that username requires contacting support@tikchat.eu.
In order to start a LIVE Session, the User presses Start after the assigned TikTok account begins broadcasting.
The Application uses data and events associated with publicly available TikTok LIVE streams.
TikChat is not an official product of TikTok, ByteDance, or any entity operating or belonging to the corporate group of the owner of the TikTok platform.
TikChat is not sponsored, authorised, endorsed or otherwise affiliated with any such entity, unless expressly stated otherwise in relation to a specific future cooperation.
The TikTok name and other designations associated with TikTok may be used within the Application solely for informational and descriptive purposes.
TikChat has no control over the operation of the TikTok platform, the availability of LIVE streams or the scope of data made available by TikTok.
Technical changes introduced by TikTok may affect the operation of TikChat, the scope of available LIVE Data or the temporary availability of certain Application features.
§ 4. Technical Requirements
In order to use the Application, the following are required:
a device capable of accessing the internet;
an active internet connection;
an up-to-date version of a commonly used web browser, in particular Chrome or Safari;
JavaScript enabled;
the ability to use necessary cookies or local browser storage;
an active email address.
Using an outdated browser, non-standard software, extensions blocking essential Application functions, or a device that does not meet the technical requirements may result in incorrect operation of the Application.
The Service Provider is not an internet access provider. Any data transmission costs shall be borne by the User in accordance with the agreement concluded with their network provider.
Correct display of LIVE Data also depends on the operation of TikTok and the availability of data relating to the relevant livestream.
Use of the Application may involve ordinary risks associated with using the internet, including attempts to obtain login credentials, malware or actions by persons impersonating other users.
The User should protect their email account, TikChat password and email confirmation links, and use up-to-date software.
§ 5. User Age
The Application is intended for persons aged 16 or over.
A person who is at least 16 but under 18 may use the free functions of the Application with the consent of their legal representative.
The Paid Plan may only be purchased by a person who is at least 18 years old and has full legal capacity.
By registering, the User declares that they meet the applicable age requirements.
By making a purchase, the User confirms that they are of legal age and authorised to use the selected payment method.
If the Service Provider obtains credible information indicating that an Account has been created by a person who does not meet the age requirements, the Service Provider may suspend the Account, request clarification and subsequently delete the Account.
§ 6. Registration and Account
Use of the Application requires creation of an Account.
Registration requires an email address and a password. The email address is verified using a one-time, time-limited confirmation link sent to that address.
The User is required to provide a genuine email address belonging to them.
The Service Provider may require verification of the email address.
A User may hold only one Account, unless the Service Provider has given prior consent to the creation of an additional Account.
It is prohibited to:
share an Account with other persons;
use another User’s Account;
sell, rent or transfer an Account;
circumvent a ban by creating another Account;
create multiple Accounts for the purpose of circumventing the free LIVE Session limit or obtaining any other undue benefit.
The User should protect access to their email inbox and password and not share their confirmation link. The User is responsible for actions carried out using their Account, unless such actions result from circumstances for which the User is not responsible.
The User should immediately notify the Service Provider if they suspect that their Account has been compromised.
The Service Provider will never ask the User to forward a confirmation link, disclose its one-time token or disclose their password.
§ 7. Rules of Using the Application
The User is required to use the Application in accordance with the law, these Terms of Use, generally accepted standards of conduct and the intended purpose of the Application.
In particular, it is prohibited to:
interfere with the operation of the Application, server, database or network connections;
use bots, scripts or other tools to circumvent Application restrictions;
interfere with the code, security features or communication between the Application and the server;
attempt to access data that is not available during normal use of the Application;
circumvent limits, blocks or security measures;
create multiple Accounts in order to circumvent free usage limits;
gain access to other Users’ Accounts;
take actions that infringe the privacy or security of other persons;
use the Application for unlawful activities;
provide unlawful content through the Application;
attempt to collect data from TikChat’s infrastructure on a mass or automated basis outside normal use of the Application.
A User who identifies an error that may affect limits, payments, security or operation of the Application should report it to the Service Provider and refrain from exploiting it.
The Service Provider may correct data concerning the number of LIVE Sessions used where such data has been recorded incorrectly as a result of:
an error;
a breach of these Terms of Use;
automation;
Account compromise;
manipulation of the Application.
§ 8. LIVE Data and Viewer-Related Functions
During an active LIVE Session, the Application may retrieve and display LIVE Data related to a publicly available TikTok LIVE stream.
The scope of LIVE Data depends on the data available to the Application during a particular stream and may vary between streams.
LIVE Data may include in particular:
username or nickname;
avatar;
TikTok user identifier;
comment content;
gifter level;
fan club status;
information about gifts;
information about following;
information about likes;
information about a user joining the livestream.
TikChat may allow the User to assign their own designation in the form of a name to a particular viewer in order to make that person easier to recognise while using the Application.
A Viewer Name assigned by the User does not modify any data held on the TikTok platform and is used solely within TikChat.
The User is responsible for information they enter into the Application, including names assigned to viewers.
The User should not enter unlawful information or data that is not necessary for the use of this functionality as a Viewer Name.
TikChat does not guarantee that all comments, events or information occurring during a TikTok LIVE stream will be received or displayed.
In particular, delays, missing data or omission of particular events may result from:
the operation of or changes to the TikTok platform;
internet connection quality;
technical limitations;
infrastructure overload;
other circumstances beyond the Service Provider’s control.
§ 9. Livestream History and Data Retention
TikChat is primarily intended to support an ongoing LIVE stream.
When a LIVE Session is stopped in TikChat or a confirmed provider-end signal is received, TikChat deletes its detailed LIVE event records, including comment text, and does not provide a searchable archive of completed chat. A session interrupted without a confirmed end may remain active until it is stopped. TikChat retains session metadata and derived statistics and rankings, which may contain TikTok identifiers and activity totals, so that existing statistics remain available.
Paragraph 3 above does not apply to data which:
is necessary to provide Account functionalities, in particular the Viewer Name functionality;
is necessary to process payments or manage a Subscription;
must be temporarily processed for technical security purposes;
the Service Provider is entitled or required to retain under applicable law.
Detailed information concerning the scope, legal basis and retention periods applicable to personal data is provided in the Privacy Policy.
§ 10. Free Version and Paid Plan
Creating an Account is free of charge.
Under the Free Version, the User may use TikChat during two qualifying LIVE Sessions in total. A session qualifies if TikChat confirms a connection and the session lasts at least ten minutes. Sessions shorter than ten minutes do not consume the Free allowance.
Once the limit of two free livestreams has been reached, starting additional LIVE Sessions requires an active Paid Plan.
Reaching the Free Version limit does not by itself automatically start a Subscription or result in any payment being charged.
Activation of the Paid Plan requires a separate action by the User and acceptance of the displayed price and payment terms.
The Paid Plan enables the User to use TikChat beyond the limit applicable to the Free Version for the duration of the active Subscription.
The exact scope of the Plan and its price are presented to the User before purchase.
The price of the Plan may be denominated in United States dollars (USD).
Purchasing the Plan is not required in order to create an Account or use the limit available under the Free Version.
§ 11. Payments and Subscription
Using the Free Version does not create a payment or Subscription. A Subscription is created only when the User separately completes Stripe Checkout.
All prices presented to Consumers include applicable taxes where such taxes are required to be included in the displayed price under applicable law.
The currency and available payment methods are indicated before an order is placed.
Payments are processed by Stripe.
Before making a purchase, the User receives information including at least:
the scope of the Plan;
the price;
the currency;
the length of the billing period;
information concerning automatic renewal;
the method of cancellation;
the date on which the Plan will become active.
The Subscription is entered into for one month and automatically renews for successive monthly periods until cancelled.
Stripe charges the selected payment method at the beginning of each billing period.
The Plan is activated without undue delay following successful confirmation of payment.
If a payment fails, Stripe may retry the payment in accordance with its rules.
Access to paid features may be suspended until payment has been successfully collected.
The User may cancel the Subscription at any time through their Account using the Stripe subscription management mechanism made available to them.
Cancelling the Subscription does not result in loss of the period already paid for. The Plan remains active until the end of the paid billing period.
After the end of the paid period, the Subscription will not renew for another month.
Merely ceasing to use TikChat, logging out or closing the browser does not cancel the Subscription.
The User should cancel the Subscription before the beginning of the next billing period if they do not wish to be charged for the following month.
The Service Provider does not refund a fee solely because the User did not use the Plan during the relevant billing period, without prejudice to the Consumer’s statutory rights.
Before deleting an Account, a User with an active Subscription should independently cancel further renewal of that Subscription.
If the User experiences problems cancelling the Subscription, they should immediately contact the Service Provider at matt@mattmedia.eu.
A sales document is issued electronically on the basis of the information provided by the User during payment and delivered electronically.
§ 12. Right of Withdrawal
A Consumer who enters into a distance contract concerning the Plan may withdraw from that contract within 14 days from the date on which it was concluded, without giving any reason, subject to exceptions provided for by applicable law.
A withdrawal statement may be submitted:
by email to matt@mattmedia.eu;
in writing to the Service Provider’s postal address.
In order to comply with the withdrawal period, it is sufficient to send the withdrawal statement before the deadline expires.
If, at the Consumer’s express request, the Plan is activated before the expiry of the withdrawal period and the Consumer subsequently withdraws from the contract, the Consumer may be required to pay for the services provided until the time of withdrawal to the extent permitted by applicable law.
Before immediate activation of the Plan, the Consumer may be asked to expressly request commencement of the service before the expiry of the withdrawal period.
In the event of an effective withdrawal, access to the Plan will be terminated and any refund due will be made no later than within the period required by applicable law.
Refunds will be made using the same payment method used by the Consumer, unless the Consumer expressly agrees to another method that does not incur any additional costs.
§ 13. Availability and Technical Interruptions
The Service Provider takes reasonable measures to ensure the proper and secure operation of the Application.
The Application may be temporarily unavailable due to, in particular:
maintenance;
updates;
fault repair;
security improvements;
the operation of the hosting provider;
failure of the payment operator or another external service provider;
changes to or failure of the TikTok platform;
changes in the manner in which LIVE Data is made available;
attacks on infrastructure;
force majeure;
the need to comply with a legal obligation.
Where possible, information about planned and material interruptions will be published within the Application.
Short-term technical interruptions and announced maintenance work do not automatically constitute grounds for extending the Plan.
In the event of an unplanned and material interruption resulting in the complete unavailability of the Application, a User with an active Plan may request an appropriate remedy, including, in justified cases, an extension of the Plan.
Such a request may be submitted to matt@mattmedia.eu.
The request should include the email address assigned to the Account, the approximate time when the issue occurred and a description of the irregularity.
The Service Provider may verify the report using available logs and technical data.
The duration of any extension shall be determined individually, taking into account the duration, scope and impact of the failure on the User’s ability to use the Plan.
The procedure described above does not limit the Consumer’s right to submit a complaint or exercise statutory rights arising from a lack of conformity of the Digital Service with the contract.
The Service Provider shall not be liable for inability to use the Application resulting solely from:
failure of the User’s device;
lack of internet connection on the User’s side;
outdated or incorrectly configured software used by the User;
loss of login credentials by the User;
actions by the User in breach of these Terms of Use.
The Service Provider does not guarantee uninterrupted availability of data originating from the TikTok platform, as it does not control the operation of that platform or the scope of publicly available data.
Nothing in these Terms of Use excludes the Service Provider’s liability to the extent that such liability may not be excluded under applicable law.
§ 14. Complaints and Contact
The User may submit complaints concerning the operation of the Application, payments, Subscriptions and other services provided.
A complaint may be submitted:
by email to matt@mattmedia.eu;
in writing to MattMedia Mateusz Olech, ul. Łokietka 5/2, 70-254 Szczecin, Poland.
Where possible, the complaint should include:
the email address assigned to the Account;
a description of the issue;
the date or approximate time of the event;
an indication of the solution requested;
optionally, a screenshot.
Failure to provide some of the above information does not automatically result in rejection of the complaint. The Service Provider may request supplementary information if it is necessary in order to consider the complaint.
A response to a Consumer complaint will be provided within 14 days of receipt.
Failure to respond to a Consumer complaint within the statutory time limit shall have the consequences provided for under applicable law.
A response to a complaint submitted by email shall be sent to the email address from which the complaint was submitted, unless the User specifies another address.
If a payment has been charged but the Plan has not been activated, the User should report the issue to matt@mattmedia.eu.
After confirming payment, the Service Provider will either activate the Plan with the appropriate effective date or issue the refund due.
A Consumer may use out-of-court consumer dispute resolution procedures, including assistance from the competent consumer ombudsman or the Polish Trade Inspection authority.
§ 15. Lack of Conformity of the Digital Service with the Contract
The Service Provider shall be liable to the Consumer for conformity of the Digital Service with the contract to the extent and on the terms provided for by applicable law.
If the Digital Service is not in conformity with the contract, the Consumer may demand that it be brought into conformity.
The Digital Service shall be brought into conformity within a reasonable period of time and without undue inconvenience to the Consumer.
In cases provided for by law, the Consumer may submit a statement requesting a price reduction or withdrawal from the contract.
When determining a reduction in the price of a Digital Service provided continuously, the period during which the Digital Service was not in conformity with the contract shall be taken into account.
A voluntary extension of the Plan or any other remedy proposed by the Service Provider does not replace or limit the Consumer’s statutory rights.
§ 16. Breaches of the Terms of Use and Sanctions
In the event of a breach of these Terms of Use, the Service Provider may in particular:
temporarily restrict access to a specific feature;
correct an incorrectly calculated free LIVE Session limit;
temporarily suspend the Account;
request that the User cease a particular activity.
In cases involving a serious, repeated or security-threatening breach, the Service Provider may terminate the agreement and delete the Account.
A sanction may be imposed without prior warning where justified by the nature of the breach, the security of the Application, protection of other persons or a legal obligation.
When selecting an appropriate sanction, the Service Provider shall take into account, in particular:
the nature and scale of the breach;
its consequences;
previous breaches;
whether the breach was intentional;
the User’s cooperation in clarifying the matter.
The User will be informed of the sanction imposed and the basic reasons for it, unless providing such information is prohibited by law or would endanger the security of the system or other persons.
The User may submit one appeal within 7 days of receiving the information by emailing matt@mattmedia.eu.
Submission of an appeal does not suspend enforcement of the sanction.
The appeal will be reviewed again and a response will be provided within 14 days.
§ 17. Copyright and Ownership of the Application
The Application, its name, logo, interface, layout, graphics, visual elements, text, code and other materials created for TikChat are the property of the Service Provider or are used on the basis of appropriate rights or licences.
The User is granted a non-exclusive and non-transferable right to use the Application solely to the extent resulting from its intended purpose and these Terms of Use.
Without the Service Provider’s prior consent, it is prohibited in particular to:
copy or distribute the Application’s code;
create copies of the Application or its material elements;
circumvent security measures;
scrape or automatically retrieve data from TikChat infrastructure;
gain unauthorised access to APIs or infrastructure;
reverse-engineer security mechanisms for the purpose of circumventing them;
use TikChat elements in a manner suggesting an official cooperation with the Service Provider without its consent.
These Terms of Use do not grant the User any rights to trademarks, data or materials belonging to TikTok or other third parties.
The TikTok name, TikTok trademarks, viewer avatars and other materials originating from the TikTok platform remain the property of the relevant entities or persons holding the respective rights.
§ 18. Notifications and Communications
The Service Provider may send the User technical messages necessary to operate the Account and perform the contract, including messages concerning:
registration;
Account security;
email confirmation links;
payments and Subscriptions, when introduced;
complaints;
material failures;
amendments to these Terms of Use;
termination of the service.
Technical messages do not constitute marketing communications and may be sent without separate marketing consent to the extent permitted by applicable law.
Marketing communications may only be sent in accordance with applicable law and on the basis of any consent required by law.
Marketing consent:
is voluntary;
is not a condition for creating an Account;
may be withdrawn at any time.
Withdrawal of consent does not affect the lawfulness of activities carried out prior to its withdrawal.
§ 19. Personal Data, Cookies and Analytics
The rules governing the processing of personal data are set out in the Privacy Policy.
The rules governing the use of cookies and similar technologies are set out in the Privacy Policy.
The Application may use files and technologies necessary for:
logging in;
maintaining a session;
security;
remembering basic settings;
payment processing;
performing functions requested by the User.
Analytics or marketing tools requiring consent may only be activated after obtaining the appropriate consent from the User.
The User should be able to reject additional technologies and change their decision at a later time.
Refusing consent to analytics or marketing does not prevent use of the basic functions of the Application.
During an active LIVE Session, TikChat may process publicly available information concerning participants of a TikTok LIVE stream to the extent necessary to provide Application functionalities.
Detailed rules concerning the processing of such information, including the categories of data, legal bases and retention periods, are set out in the Privacy Policy.
§ 20. Account Deletion and Termination of the Agreement
The User may terminate the agreement relating to the free Account at any time by deleting the Account through the Application settings, if such functionality is available, or by contacting the Service Provider.
A User with an active Subscription should cancel further renewal of the Subscription before deleting the Account.
Deleting the Account does not constitute cancellation of a Subscription processed by Stripe.
After Subscriptions are launched, the Application may prevent immediate Account deletion until an active Subscription has been cancelled or may allow the Account deletion to be scheduled for the end of the paid billing period.
If the User requests immediate Account deletion before the end of the paid billing period, the User may lose access to the Plan for the remainder of that period, without prejudice to the Consumer’s statutory rights.
Account deletion results in deletion or anonymisation of data associated with the Account, except for data which the Service Provider is entitled or required to retain.
Account deletion may result in the loss of saved settings, including information assigned by the User to individual viewers.
Account deletion is, as a rule, irreversible.
The Service Provider may terminate the agreement in the event of a serious or repeated breach of these Terms of Use, subject to the rules set out in § 16.
§ 21. Discontinuation of the Application
The Service Provider may discontinue the Application for important reasons, including:
economic reasons;
technical reasons;
legal reasons;
security reasons;
loss of access to infrastructure necessary for operation of the Application;
changes to the TikTok platform that make continued operation of TikChat’s core functionalities impossible.
Users will be informed of any planned discontinuation through the Application or by email with reasonable prior notice, where prior notice is possible.
No new Subscription fees will be charged after the Application has been discontinued.
A User with an active Subscription will receive a refund corresponding to the period between discontinuation of the Application and the end of the paid billing period, if any such period remains.
Refunds will be initiated through Stripe where technically possible.
§ 22. Changes to the Application and Terms of Use
The Service Provider may develop and modify the Application, including by adding, modifying or removing features.
A modification of a paid Digital Service that is not necessary to maintain its conformity with the contract may be made for justified reasons, including:
changes in law or its interpretation;
the need to adapt the Application to security requirements;
prevention of abuse;
technical development;
changes to external services used by the Application;
technical or functional changes to the TikTok platform;
the need to replace a function with another function serving a similar purpose;
low use of a particular function;
the need to improve performance or compatibility.
A change may not result in additional costs for the Consumer without their express consent.
The User will be informed of amendments to these Terms of Use within the Application or by email with reasonable prior notice, generally at least 14 days before they enter into force.
The period specified in paragraph 4 may not apply where the amendment:
is beneficial to the User;
is purely editorial;
is necessary in order to immediately eliminate a threat;
results from a mandatory legal provision or a decision of a competent authority.
If a modification of the paid Digital Service materially and adversely affects the Consumer’s access to or use of the service, the Consumer will be informed in accordance with applicable legal requirements.
In cases provided for by law, the Consumer may terminate the agreement without notice as a result of such modification.
Amendments to these Terms of Use shall not prejudice rights acquired by the User before the amendments entered into force.
§ 23. Final Provisions
Agreements entered into under these Terms of Use shall be governed by Polish law, without prejudice to any protection granted to the Consumer under mandatory provisions of the law applicable in the Consumer’s place of residence.
Matters not regulated by these Terms of Use shall be governed by applicable law, including in particular:
the Polish Civil Code;
the Polish Act on Providing Services by Electronic Means;
the Polish Consumer Rights Act;
the Polish Act on Copyright and Related Rights;
the GDPR and the Polish Personal Data Protection Act;
the Polish Electronic Communications Law;
other applicable provisions governing digital services.
Disputes between the Service Provider and a Consumer shall be resolved by the competent court in accordance with applicable law.
If any individual provision of these Terms of Use is found to be invalid or ineffective, this shall not affect the validity of the remaining provisions.
These Terms of Use enter into force on 23 September 2026.
